Broccoli Vs. Health Insurance Vs. Wheat ? Cheap Talk

Broccoli vs. Health Insurance

You can?t eat broccoli without paying for it. You can get health insurance without paying for it because hospitals are obligated to treat you if you turn up at the ER door. This means society is providing health insurance for free to some people. They are being subsidized by the people who pay for health insurance. There is no such issue with broccoli. Note I am using the phrase health insurance not health care as some of the justices tried to make a distinction between the two.

We can turn heath insurance into broccoli by denying care at the ER door to the uninsured. This is feasible as healthcare services are excludable. Whether society wants to do that are not is a political judgement. Hence, elections are the right mechanism to determine this issue.

Broccoli vs. Wheat

Via the New Yorker,

the Commerce Clause of Article I, Section 8 of the Constitution, [gives] Congress the power

To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes.

How has this been interpreted? Again, via the New Yorker:

In the famous 1942 case of?Wickard v. Filburn, the Court said that the federal government?s authority extends to any activity that ?exerts a substantial economic effect? on commerce crossing state lines.

The case involved Roscoe Filburn, an Ohio farmer who wanted to grow more wheat than he had been allotted under quotas introduced during the Great Depression to drive up prices. In deciding against Filburn and in favor of the Department of Agriculture, the justices pointed out that the actions of individual wheat farmers, taken together, affect the price of wheat across many states. That is what gives the federal government the power to limit their actions.

This argument can be made for any good, private or public. Hence, the externality argument made above is not necessary under this precedent. Also, Justice Scalia, Roberts etc can be forced to buy broccoli by law.

What is then the limiting principle? The commerce clause has no limiting principle, according to me, a non-lawyer. The limiting principle is the?imposed by politics:?any politician who seeks to regulate the broccoli market must run for election. This politician will reach the limit of his political career.

Chinese firm surpasses Exxon as world's largest

Big U.S. oil is not as big as it used to be.

Exxon Mobil has lost its position as the world?s biggest publicly traded producer of oil, according to The Associated Press.

That distinction now belongs to PetroChina, a 13-year-old Chinese company created by the Chinese government to secure more oil for that nation?s booming economy, the report said.

PetroChina announced Thursday that it pumped 2.4 million barrels a day last year, surpassing Exxon by 100,000, the AP reported.

?The company has grown rapidly over the last decade by squeezing more from China's aging oil fields and outspending Western companies to acquire more petroleum reserves in places like Canada, Iraq and Qatar. It's motivated by a need to lock up as much oil as possible,? according to the report.

Back before I had a kid, I used to take weekly Pilates classes at a local studio. While many of the moves bore passing resemblance to those we do in my yoga class, it was unabashedly a workout?a sweat-inducing, core-honing, fast-paced workout. I loved it (and so did my abs). But then my daughter came along and something had to give, so I said goodbye to Pilates, but I missed it!

So when I had the opportunity recently to test out two home Pilates systems, I was delighted! Here?s what I discovered:

Portable Pilates Studio by Empower Fitness
Pros: This deceptively simple system (it?s just a bar with a resistance cord and foot strap at each end) is easy to put together, and you can follow the workouts on the DVD or just go free-style, twisting, curling, and lifting in all sorts of directions. The DVD is versatile, offering three workouts (plus a bonus arms sequence) that you can mix and match. Instructor Gin Miller gives excellent direction, and while the routines are pretty simple, they?re still challenging.
Cons: The quick-reference poster only offers six exercises.
Cool extra: The moves are often shown in split screen, from two different angles?really helpful when it comes to getting just the right form.

CoreBody Reformer by Nautilus
Pros: Where do I start? I loved this! It?s sturdy and easy to assemble, and the end bar unscrews to store inside the body of the system (called the Roller) when you?re done. The cords have three levels of resistance, and you can switch from one to the other with, literally, the press of a button. I can?t say enough about the accompanying DVD?trainer Jennifer Galardi gives terrific, detailed instructions (she?s very likeable), and the workouts combine strength, cardio, balance, and lots of core work for a true full-body challenge. But don?t get me wrong?you don?t have to use the DVD. My daughter and I had a blast using it as a balance beam, then making up our own moves with the resistance cords. More good stuff: It also comes with a track-your-workouts poster, a collection of workout cards, and a washable cover.
Cons: There?s a carrying strap so you can schlep the Reformer around, but it?s pretty heavy, so you may not want to go far. Also, the two Stabilizers that hold the Roller in place don?t fit inside the unit for storage.
Cool extra: Use it like a foam roller for an awesome massage. You can either follow the ?Renew? part of the Stretch & Renew routine, or just do whatever feels good on your deserving muscles.

Tech firms cry foul in Taiwain

High-tech firms in Taiwan say they developed numerous firsts like all-in-one PC computers that became market successes only after being rebranded in the United States, Japan, or South Korea.

A lawsuit by a little-known Taiwanese high-tech firm against Apple has joined the list of uphill legal cases against Silicon Valley.

Working on computer hardware contracts for 30 years, Apple?s onetime partner Proview International Holdings alleges ?fraudulent actions? by the computer giant to acquire iPad trademarks. But Proview?s would be just one case. High-tech firms in Taiwan say they developed numerous firsts that became market successes only after being rebranded in the United States, Japan, or South Korea. Proview?s claim joins that of Taiwan-based Elan Microelectronics, which sued Apple in 2009 over patents for the touchpad.

In addition, several Taiwanese firms claim to have come up with the ?all-in-one? compact desktop computer in 2007 only to find it sold later by Apple and Lenovo, says Helen Chiang of market research firm IDC in Taipei.

Taiwan lags behind overseas peers because its tech firms, facing slimmer profits from contracts, only started branding their own PCs within the past five to 10 years, the Taiwanese government and private analysts say.

?The problem isn?t with product functions or technology,? says Hanson Tseng, strategic marketing executive director with the Taiwan External Trade Development Council. ?It?s about whether the brand can be advanced.?

World News - Iranian weapons help Bashar Assad put down Syria ...

Europe's attempts to punish Syria's brutal regime turned today to the British-born wife of President Assad. Asma al-Assad was banned from traveling to Europe and her financial assets were frozen. But the sanctions may be largely impotent, as a UK passport holder she can't be prevented from entering the UK. ITV's Paul Davies reports

WASHINGTON -- Iran is providing a broad array of assistance to Syrian President Bashar Assad to help him suppress anti-government protests, from high-tech surveillance technology to guns and ammunition, U.S. and European security officials say.

Tehran's technical assistance to Assad's security forces includes electronic surveillance systems, technology designed to disrupt efforts by protesters to communicate via social media, and Iranian-made drone aircraft for overhead surveillance, the officials said. They discussed intelligence matters on condition of anonymity.


"Over the past year, Iran has provided security assistance to Damascus to help shore up Assad. Tehran during the last couple of months has been aiding the Syrian regime with lethal assistance - including rifles, ammunition, and other military equipment -- to help it put down the opposition," a U.S. official said.

"Iran has provided Damascus (with) monitoring tools to help the regime suppress the opposition. It has also shared techniques on Internet surveillance and disruption," the official continued.

Syrians brave gunfire in anti-Assad protests

He added that Iran had also provided Assad's government with "unarmed drones that Damascus is using along with its own technology to monitor opposition forces."

Syria's rebel fighters are desperate for arms and ammunition. Members of the Free Syrian Army were forced from Idlib - one of the last rebel strongholds. ITN's John Irvine reports from outskirts of Idlib, the north western city which rebels surrendered last week.

Iranian security officials have also traveled to Damascus to advise Assad's entourage how to counter dissent, the official said. Some Iranian officials have stayed on in Syria to advise Assad's forces, he added.

Iran's multi-pronged security aid to Syria appears to have helped Assad's government in its increasingly violent campaign to hold on to power in the face of a year-long protest movement. The United Nations estimates 8,000 civilians have died in the conflict.

However, the U.S. and European officials said the Syrian government's survival is not totally dependent on continuing help from Tehran.

Assad's wife banned from traveling, shopping in EU

U.S. and allied official broadly agree that Assad's control remains solid. His opponents are hopelessly disorganized, the officials said, which may make it possible for the Syrian president and his entourage to hold onto power for years.

"At current levels Iranian aid is important but not really a game changer in the overall conflict," a U.S. official noted.

Paul Conroy, a photographer for the Sunday Times, was badly injured while on assignment in Syria and his colleague ? legendary war correspondent Marie Colvin was killed. Conroy joins NBC's Andrea Mitchell to reflect on the situation.

Iran has for decades been a patron to Syria, which has helped funnel aid and weapons to the Iranian-backed Shiite Muslim militia Hezbollah in Lebanon.

During the protests that followed Iran's disputed 2009 presidential election -- the biggest mass protests since the Islamic Republic's founding in 1979 -- Iranian authorities disrupted social media, such as Facebook and Twitter, as well as cell phone networks.

Iran's internal crackdown reportedly has escalated since then.

A European official said that the Iranians were providing Syrian security agencies with hardware and software that would help them disrupt efforts to organize protests inside Syria and efforts by anti-government elements to spread their message to supporters outside the country.

Officials said that Syria had also obtained some surveillance technology from European suppliers.

As protests against Assad's rule grew last year, the United States first raised the possibility that Iranian authorities were helping their Syrian counterparts suppress dissent.

Last June the U.S. Treasury Department announced economic sanctions against two of Iran's most senior police officials for allegedly helping Assad's government crush protests.

The Treasury imposed U.S. economic sanctions on Ismail Ahmadi Moghadam and Ahmad-Reza Radan, chief and deputy chief of Iran's national police force, because their agency had "provided support to the Syrian General Intelligence Directorate and dispatched personnel to Damascus in April to assist the Syrian government in suppressing the Syrian people."

The Treasury alleged that Radan had traveled to Damascus to meet with Syrian security agencies, to whom he allegedly provided "expertise to aid in the Syrian government crackdown on the Syrian people."

U.S. officials said Iranian efforts to bolster Syria's surveillance capabilities have been supplemented by deliveries to Syria of Iranian-made unarmed surveillance drone aircraft.

Earlier this month a specialized website, The Aviationist, reported that a drone flying over the city of Homs, the site of recent violent clashes between government and opposition forces, had been identified as a "Pahpad" drone, which the website said meant "remotely piloted aircraft" in Farsi.

Saudi Arabia will deliver military equipment to Syrian rebels in an effort to stop the bloodshed. NBC's Ayman Mohyeldin reports.

In February another specialized website, Open Source GEOINT, published freeze-frame images from what purported to be an amateur cameraman's video of a suspected drone flying over a Damascus suburb.

Iran vows to retaliate 'on the same level' to US or Israel attack

The website noted that some news reports had suggested that the United States was flying intelligence drones over Syria but that the drone in the pictures did not appear to be a U.S. model.

The website cited speculation that the drone might be of Iranian origin. Ynet News, an Israeli website, reported this month that Syria's defense industry produces drones that are technologically identical to Iranian-produced models and speculated that these domestically produced models were what Syrian security forces had deployed.

Report: 'I am the real dictator,' Bashar's wife says

However, a U.S. official said that some of Syria's drones had come directly from Iran.

Last weekend the Iranian news agency Fars announced that Iranian experts had produced what it called a "new type of drone" known as the Shaparak, or "Butterfly," which it said was "capable of carrying out military and border patrol missions."

I am 26 years old, graduated in Poly. Sci and Japanese out of college. I taught English abroad for a year, now I work in an embassy, ??but I look at a computer for eight hours a day and I know it is not my vocation. I do not know what I do with my life. It seems that most people who majored in what I specialize in going to law school or graduate. Everywhere I look people my age, you get married, settle down, buy homes, and just generally being successful. I know I want to go back to school, but I do not know what I want to do yet. I like working with people and I also love being outdoors. Money is not a huge deal for me as I can live comfortably and support my family when I have one. I thought back to school to get a nursing degree, master?s or possibly public health, although I have to take some courses in bio. I am also passionate about the environment. Should I go back and get another single or is it a waste of time? Advice? Best answer:

I would go for a masters in international business or human resource management ? you have a great base that just needs a little tweaking. I would not single. Your basic degree is not one that would allow for much more, but outdoors with working with people. You get into a position that requires some travel so you can see over there until you meet the right one.

Sellers can even have the buyer agree to handle all home repairs and maintenance, placing the burden on the renter if anything goes wrong with the house, and alleviates the need for the seller to act as landlord.

While Kramsky says it?s not common from renters to walk away from a rent-to-own deal, it does happen, particularly if they don?t qualify for a mortgage at the end of the lease term. ?Maybe they lose their job or maybe they are relocated or were unable to save money. There are many factors,? he says.

In sum, there are definitely situations where Rent to Own Agreements can benefit all parties.

(AP) ? The Supreme Court will begin hearing arguments on Monday over President Barack Obama's health care overhaul, the Patient Protection and Affordable Care Act, derisively labeled "Obamacare" by its opponents. A look at how the case will unfold before the court in question-and-answer form:

Q: What's this all about?

A: The Supreme Court is hearing a challenge to the Patient Protection and Affordable Care Act, which is Obama's signature domestic achievement. Passed by Congress in 2010, its aim is to provide health insurance to more than 30 million previously uninsured Americans, while trying to restrain costs and prevent disruptions to the majority already with coverage. Opponents say the law is unconstitutional; their chief argument is that Congress does not have the power to force unwilling Americans to buy health insurance or pay a fine.

Q: When will the court get started?

A: Justices will begin hearing arguments shortly after 10 a.m. EDT Monday, March 26. They will hear six hours of arguments on several different issues on Monday, Tuesday and Wednesday.

Q: Which issues on which days?

A: Monday's 90-minute argument is about whether court action is premature because no one yet has paid a fine for not having health insurance. Tuesday's two-hour argument will cover the central issue of whether Congress overstepped its authority by requiring Americans to purchase health insurance starting in 2014 or pay a penalty. Wednesday's arguments will be split into two parts: Justices will hear 90 minutes of debate in the morning over whether the rest of the law can take effect even if the health insurance mandate is unconstitutional and another hour Wednesday afternoon over whether the law goes too far in coercing states to expand the federal-state Medicaid program for low-income people by threatening to cut off federal aid to states that don't comply.

Q: When will the justices rule?

A: The court could decide any time, but complex cases argued in the spring normally produce decisions near the end of the court's session, scheduled for late June.

Q: Is it possible that the justices won't decide whether the law is constitutional or not?

A: It is possible. The first issue the court is discussing is whether an obscure tax law makes it too early for the Supreme Court to get involved. If they decide that the issue is premature, then the case will be dismissed without a binding ruling from the justices.

Q: What did lower federal courts say?

A: The 11th U.S. Circuit Court of Appeals in Atlanta ruled that Congress overstepped its authority when lawmakers passed the insurance mandate, the only appeals court to come to that conclusion. The 6th U.S Circuit Court of Appeals in Cincinnati upheld the entire law, as did the U.S. Court of Appeals for the District of Columbia Circuit in Washington, D.C. The 4th U.S. Circuit Court of Appeals in Richmond, Va., ruled that the question was premature and the law can't be challenged in court until after 2015, when the first penalties for not having insurance would be paid.

Q: Who are the justices on the Supreme Court?

A: The chief justice is John Roberts, who joined the court in 2005 after being nominated by President George W. Bush. In order of seniority, the other justices are Antonin Scalia (confirmed in 1986 after being nominated by President Ronald Reagan), Anthony Kennedy (1988 by Reagan), Clarence Thomas (1991 by President George H.W. Bush), Ruth Bader Ginsburg (1993 by President Bill Clinton), Stephen Breyer (1994 by Clinton), Samuel Alito (2006 by President George W. Bush), Sonia Sotomayor (2009 by Obama) and Elena Kagan (2010 by Obama.)

Q: Who will be arguing for the law?

A: Solicitor General Donald B. Verrilli, Jr. will argue for the government on Monday and Tuesday. Deputy Solicitor General Edwin S. Kneedler will present part of the government's case on Wednesday, and Verrilli will do the rest. Information about Verrilli and the solicitor general's office can be found here: http://www.justice.gov/osg/index.html . A court-appointed lawyer, H. Bartow Farr III, will also argue that if government cannot require people to buy health insurance, all other provisions of the law can go into effect. Another court-appointed lawyer, Robert Long, will also argue that the lawsuits challenging the insurance purchase requirement are premature because the penalty has yet to be imposed.

Q: Who will be arguing against the law?

A: Representing Florida on Monday will be Washington appellate lawyer Gregory G. Katsas. Former Solicitor General Paul Clement, now in private practice, will represent Florida on Tuesday and Wednesday. Former Justice Department attorney Michael A. Carvin will represent the National Federation of Independent Businesses.

Q: Can I go watch the arguments, and if I can't make it to Washington, can I watch on television or online?

A: The Supreme Court does not allow live television or radio broadcasts from inside its building, so the only way Americans can actually see or hear the arguments live is to be inside the courtroom while lawyers and justices debate. There are seats reserved inside the courtroom for members of the public on a first-come, first-served basis, with some people allowed to stay for the entire argument while others have to leave the courtroom and give their seats to the next people in line after 3-5 minutes. Q: What type of health care do the justices get, and will they be affected by their ruling?

A: The justices participate in the same health care plan as members of Congress and other federal workers. As participants in an employee-sponsored health care plan, it is unlikely that whatever decision the Supreme Court makes will substantially affect their personal health care insurance.

Q: I've heard people say that Justices Elena Kagan and Clarence Thomas should take no part in this case? What's that about?

A: Opponents of the law wanted Kagan to disqualify herself because she served as solicitor general under Obama when the health care overhaul law was conceived and passed. She has said she did not participate in crafting a legal defense for the law, but her detractors doubt her statement. Thomas' detractors insist that he should have disqualified himself because his wife, Ginni, worked with groups that opposed the new law.

Decisions to stay out of a case are the responsibility of each individual justice, and neither Kagan nor Thomas justice stepped aside.

Roberts said in his 2011 year-end report that he has "complete confidence in the capability of my colleagues to determine when recusal is warranted. They are jurists of exceptional integrity and experience whose character and fitness have been examined through a rigorous appointment and confirmation process. I know that they each give careful consideration to any recusal questions that arise in the course of their judicial duties."

'Hunger Games' Fans 'Blown Away' At Midnight Showing

Early reports predict midnight box-office totals of more than $18 million.

With midnight showings of "The Hunger Games" sold out for weeks in advance, expectations for the highly anticipated film were even higher for those brave enough to journey to theaters in the middle of the night. Thankfully, Katniss Everdeen and the rest of the tributes did not disappoint.

Early reports for the midnight box-office totals predict returns north of $18 million, according to Variety. Those figures put "The Hunger Games" in contention with "The Dark Knight" and "Harry Potter and the Half-Blood Prince," which earned $18.5 million and $22.2 million at midnight, respectively. Early predictions for the weekend total estimate "The Hunger Games" earning $125 million.

MTV News caught some rabid fans on their way out of the first showings of "The Hunger Games" in New York City, and most of them couldn't have been more pleased.

Joanna Cruz said she was left "speechless" and was "on the edge of my seat the whole time." Some took their praise ever further. Judith Cruz called it the "the best movie ever." "I can't wait to see it again," she said. "It was awesome. I cried at certain parts."

Though most of the people we interviewed expressed their love of the movie as a whole, a few couldn't help but point out that they missed some scenes that ended up on the cutting-room floor. "I loved it. I thought it was awesome," Elena Lerner said. "It wasn't completely true to the book — they left out a few scenes — but overall, we were both freaking out in our seats. It was so good."

Josh Solomon felt similarly. "I thought the film was very good, well done," he said. "It missed a couple scenes from the book. It missed spots, but I thought it was done pretty well."

But for one fan in particular, the movie could never live up to the book. "I don't know how I feel about it. When I read a book, I get very in-depth, and I felt like they missed a lot of what was in the book," Samantha Cohen said.

On the other hand, Esther Portyansky said that the movie was a reminder of why she liked the book so much in the first place. "It was incredible. I was absolutely blown away by it," she said. "I read the books last summer, and I think I'd almost forgotten how amazing they were, frankly. The movie more than did it justice."

Whitney Houston Cause of Death: Heart Attack, Cocaine


The Los Angeles County Coroner has released the official cause of death for Whitney Houston.

According to the report, the singer passed away due to an "accidental drowning" that was related to heart disease and also the presence of cocaine in her system.

An insider tells TMZ that it's "very possible" the heart attack caused Whitney to pass out and fall under the water. It's also likely this was triggered by the use of cocaine. It should be noted, however, that no cocaine was found in the hotel room where Houston passed away.

Law enforcement officials have said from the beginning that no foul play was involved in the tragedy and nothing in this report suggests anything different.

Perhaps now folks such as Nancy Grace can let Whitney rest in peace.

French suspect showed no sign of militant leanings

PARIS (AP) ? Just a few weeks ago, Mohamed Merah partied at a nightclub, and an acquaintance noticed nothing out of the ordinary. Another friend said the former car body shop worker liked to talk about "cars, bikes, girls and sports."

On Wednesday, both friends stood stunned near a huge police cordon in a blue-collar neighborhood in the southwestern city of Toulouse, where negotiators were trying to get Merah to surrender.

The 24-year-old Frenchman of Algerian descent was holed up in his apartment after exchanging gunfire with police and suspected of killing three Jewish children, a rabbi and three paratroopers in three separate attacks in southern France.

Prosecutor Francois Molins told reporters that Merah was a self-taught Salafi Muslim who had been to Afghanistan twice and had trained in the Pakistani militant stronghold of Waziristan. He also had a long criminal record, the prosecutor said, adding that the suspected gunman's brother had been implicated in a 2007 network that sent militant fighters to Iraq.

Just before police swarmed around the apartment in the pre-dawn darkness, Merah called a French television journalist and calmly took responsibility for all of the attacks ? saying he carried them out to protest France's ban on veils in public places, the nation's military presence in Afghanistan and in revenge of the deaths of "Palestinian children."

"He sounded very determined," France 24 senior editor Ebba Kalondo said. "He's also very convinced by his own convictions."

Molins confirmed that Merah told authorities he made the call to Kalondo.

But according to the acquaintance at the nightclub, Mehdi Nedder, nothing about Merah's social life in Toulouse before the French attacks made him stand out as a radical bent on sowing terror ? or even that he had radical leanings.

Nedder, 31, described Merah as a "normal young man."

"Three weeks ago he was in at a nightclub," Nedder told The Associated Press. "And this morning I hear we're talking about al-Qaida. How can you change like that in three weeks?"

A friend of Merah's who would only identify himself by his first name, Kamel, recalled playing soccer with him as the two grew up in Toulouse.

"(He) was respectful and generous," said Kamel, 24. "We never spoke about weapons, religion or politics, but cars, bikes, girls and sports."

Police detained Mehdi's mother and brought her to the standoff scene to try to get her to negotiate Wednesday with her son, but she declined, saying she had no control over him, French authorities said.

As a teenager, Merah got caught up in petty crime, some of it involving violence, said his lawyer, Christian Etelin. But Etelin said the recent wave of deadly shooting attacks didn't fit the profile of the suspect he first represented in 2004.

"He was a polite and courteous boy" who used to work in a body shop, Etelin said.

The lawyer added that if Merah had dark secrets, "it remained clearly secret. He gave the impression of being in French social life."

However, Etelin also said he was aware that Merah had been monitored by authorities after he made a visit to Afghanistan two years ago.

Western officials have been concerned for years about Muslim militants with European citizenship visiting northwestern Pakistan, possibly training for missions that could include terror attacks in Europe where they would act as "lone wolves" or on the orders of others. In 2010 alone, dozens were believed to be there.

French authorities did not say whether they were aware that Merah had been training with militants before the attacks in France that began March 11 ? or if they learned of the training after they closed in on him.

A person of the same name was arrested in southern Afghanistan five years ago and escaped from his prison cell in Kandahar province in a 2008 mass Taliban jailbreak, according to Kandahar provincial spokesman Ahmad Jawed Faisal. However, Faisal says their records also show that Merah was an Afghan citizen from Kandahar province.

In neighboring Germany, which regularly tracks extremists who head to Afghanistan or Pakistan for paramilitary training, a senior intelligence official said that he had never seen Merah's name come up. He spoke on condition of anonymity because he was not authorized to discuss the issue with the media.

American officials have kept in close contact with French authorities as the killings of soldiers and Wednesday's standoff evolved, and are now "working to determine what the suspect's ties to al-Qaida might be," a U.S. official said, speaking on condition of anonymity because the investigation was ongoing.

British officials want to know whether Merah "was simply affiliated with a group, or whether someone in a group was giving him specific instructions," said a British official who spoke on condition of anonymity because of the sensitivity of his job. "At this stage, that doesn't appear to be the case but it's still in early days."

Merah's criminal record was mostly for petty offenses. Etelin said Merah was in prison from December 2007 to September 2009 for a mugging. The lawyer tried to get the sentence reduced or converted, but failed, and he speculated that could have "provoked hate for the justice system" and "laid the groundwork from which he threw himself into this religious fanaticism."

His last conviction came Feb. 24 for a minor motorcycle accident and driving without a permit, his lawyer said. He was sentenced to a month in prison, and was supposed to appear before a judge to have the sentence finalized and start serving April 3 or 4.

Etelin said he knew Merah since he was about 17, and described his life as typical for many teenagers and young men in poor French housing projects who get involved in criminal activity.

"His mother couldn't control him, his father was totally absent, his sister ... also told me that she couldn't exercise any influence over him," the lawyer said.

Etelin last saw Merah in February, and "found him like someone who had gained in maturity."

But Merah "did not give the impression of someone hatching plans, retaining violence, absolutely not the air of someone letting you think of a certain fanaticism. Not at all."

Asked if he would defend him, the lawyer said, "If he asks me to defend him I would defend him because I want to talk to him, I want to understand. something escapes me."

Why Egalitarianism Failed My Marriage ? The Good Men Project

Does your marriage feel like a constant power struggle? Have you ever thought about the ?old way? of doing things and wondered if there?s something to it?

Let me start with a disclaimer: I understand that some of the things I say might seem offensive, or misogynist. I only ask for a fair shake and an open mind, and I promise to reciprocate.

My wife and I are coming up on our 5-year anniversary. As I reflect on these past 5 years of marriage, it?s pretty interesting to see the twists and turns we?ve taken. We?re completely different people than we were, and I?m glad. Here?s our story.

Shy nerdy boy (that?s me!) meets edgy, rebellious girl. Shy nerdy boy thinks he can ?save? edgy girl with his love, compassion, and wisdom. (An almost laughable statement, looking back at 16-year-old me.) He ends up learning a whole lot more from the relationship, like how to come out of his shell, live a little, and oh yeah, actually carry on a normal conversation with someone else.

They get married at 18 and 19 with every confidence that true love will overcome all obstacles. (Does this story sound familiar yet?)

It started out good but went sour fast. It was everyday combat ? anything from who?s going to drive today to who?s going to cook, do the dishes, take care of the dogs, etc. Granted, we both hated our jobs and were always exhausted. But looking back, one major flaw in our relationships was we were always self-focused, not focused on each other. And I think the reason is that both of us were desperately trying to play roles that we weren?t meant to.

My reaction to these power struggles was to just start giving in. I carried the calmer demeanor of the two of us, and I?m also a chronic conflict-avoider. So I?d just bow out, again and again and again. But, as some articles here have mentioned, most women don?t really want a passive man for a husband. My wife didn?t either. So, goodbye emotional intimacy.

It was a pretty dark chapter in our marriage?there was a period where, after only a year or so into marriage, my mantra of ?I?ll never get divorced? started to transition into ?maybe this was a bad idea.? And once you let your mind down that rabbit hole, it ends up in some pretty dark places.

It was around this time that we decided to find a church. (I know, I know, here comes the sappy, God-saved-my-marriage story.) We actually didn?t really see just how screwed up our marriage was yet?we just wanted to meet some friends, and church seemed like the place to do that.

This church was probably one of the best things that has ever happened to us. Within months, we both started changing. We both had a sense of purpose that went beyond paying the bills and making our way through our Netflix queue.

At some point in the last few years, we got introduced to the concept of complementarianism?an alternative to egalitarianism that teaches on ?different but equal? gender roles for men and women, especially in a marital context. I was pretty hesitant as this sounded a lot like those ?crazy evangelicals? who want to bring us back in time to the Cleavers.

But around the same time, we started talking about wanting to start a family, and both of us felt very strongly that if we were going to have kids, we wanted to make them the focus of our life. We wanted to pour our best into them. I had experienced the huge blessing of having a parent around 24/7?my wife had not because her father died when she was young and her mom had to work and raise the kids.

So, we wanted a devoted parent, but at the time I didn?t know what that would look like. I thought maybe I would get a work-from-home job and stay with the kids? But around that same time, my wife became fairly adamant: ?I?d like to quit my job and stay home with the kids,? she told me.

There?s been more changes than just that though ? I?ve begun to take a lead role in financial management, overall family vision, making major decisions, etc. From my perspective, the new role and responsibility has driven me to step up a lot more, to fight hard for our family and feel good about it. (Like the whole ?with great power comes great responsibility? thing.)

From my wife?s perspective (these are her words), she feels like our changing roles have cut down on arguments, helped her to feel more clear about responsibilities and expectations, and she has gained peace from not feeling the need to control everything. I have also seen her relationships with other women improve a lot, and I?ve seen her grow in all types of handy skills (she?s made her own yogurt, mayonnaise, and ranch dressing in the past week). She also reports being a lot happier. :)

So here?s where I?m probably going to heat a few kettles. I believe that men and women are different, and that it?s dangerous to ignore these differences when it comes to marriage.

One thing I?ve observed in a lot of men is that they either skew toward passivity or skew toward domination. The passive men (who I think are the majority) need responsibility?I know I did. The domineering men need accountability. (One way to accomplish this is regularly meeting with, and baring your soul with, a few other men that aren?t afraid to tell you if you?re way off base. I strongly recommend this for both men and women.)

As for women, well, my perspective is probably weak at best here ? but from what I?ve seen most women want freedom to make their own decisions and live their own life but they also want a husband who has a plan, has a vision, and has the courage and discipline to execute that family vision.

When a wife takes control, either by choice or out of necessity?I see this all the time where the wife brings home the bacon, raises the kids, and takes care of the house?she?ll most likely resent her husband for being lazy. But lo and behold, the husband quickly feels disrespected and not needed, so he checks out.

Maybe these stereotypes seem really sexist and really unfair ? you?re probably right. But have you not seen this play out before? Maybe it?s just my circle, but I see this happen. All. The. Time.

Every marriage is different. Every balancing act is going to look different ? the roles are going to look different. Same with same-sex relationships. I?m not saying it?s my way or the highway?but I do know that this family relationship has taken a lot of stress and tension off of both of us. I think a knee-jerk reaction that calls a male-led model ?oppressive? probably does more to hinder rather than help couples that might benefit from it.

Are power struggles getting in the way of intimacy in your marriage? Or am I totally off my rocker? Happy to hear either opinion but let?s keep it respectful. We?re all just sorting through this maze together.
